CatsOnly Privacy Policy

1. WHO WE ARE

CatsOnly, LLC (referred to in this Privacy Policy as “CatsOnly,” “we,” “us,” “our” or words of similar import) is building a specialized network of feline-only hospitals, rooted in a reverence for cats. Our mission is to transform the landscape of feline healthcare by championing gold-standard, species-specific care and raising the bar for cats, their caregivers, and the bond they share.

2. WHAT THIS PRIVACY POLICY COVERS

Your privacy is important to us. This CatsOnlyTM Privacy Policy (“Privacy Policy”) describes, among other things, what “Personal Information” we collect about you, how we collect your Personal Information, how we use your Personal Information, including who we disclose it to and why, the measures we take to protect your Personal Information and the choices you have regarding our use of your Personal Information. The term “Personal Information” is defined below in the section entitled “Personal Information We Collect.

This Privacy Policy covers all of our services where this Privacy Policy is posted or referenced, including our website, which is currently located at https://catsonly.vet/ (the “Site”), establishing a client relationship with us, placing orders for prescriptions, and our customer support services (collectively, and including the features provided by our Site, the “Services”). We recommend that you read this Privacy Policy carefully and in its entirety. It is important that you understand what Personal Information we collect about you and what we do with that Personal Information.

3. CHILDREN’S USE OF OUR SERVICES

Our Services are not intended to be used by, and we do not knowingly collect Personal Information from, children under the age of 13. Additionally, we do not knowingly sell or share Personal Information from individuals we actually know are under the age of 18. If you are a parent or guardian and believe we may have collected Personal Information about your child, please contact us as directed below in the Section entitled “How to Contact Us.

Please note that this Privacy Policy may change from time to time, as described below in the Section entitled “Changes to Our Privacy Policy.”

4. PERSONAL INFORMATION WE COLLECT

As used in this Privacy Policy, “Personal Information” means information that, on its own or in combination with other information, can be used with reasonable effort to identify an individual, including information such as your name, e-mail address, physical address, phone number, and credit card information.

You do not need to provide us with any of your Personal Information to simply browse our Site. However, if you want to interact with our Site, establish a client relationship with us, or use any of our other Services, you will need to provide certain Personal Information about yourself to us.

The Personal Information we collect about you can be broadly categorized as follows: (a) information we collect directly from you, (b) information we collect from third party sources, and (c) information we collect automatically by using data collection technologies.

  1. Information You Provide Us Directly

You provide us Personal Information through the use of the Services, such as when you create an account on our Site, register with us to obtain our newsletter and other offerings, make purchases of products or services, request information or materials, consult with our customer service team, or communicate with us in any way.

In most cases, providing us Personal Information is voluntary on your part but if you do not do so, we may not be able to provide certain Services to you or fulfill your request.

The Personal Information you provide to us directly when you access or use our Services may include:

  • Contact Information: We collect your name, physical address, email address, and telephone number.
  • Account Information: We collect information you provide to us to create and register an account with us, such as your username.
  • Demographic Data: We may collect demographic information about you, such as your age or date of birth.
  • Financial Information – We collect payment information such as your credit card and debit card information if you make any purchases.
  • Commercial Information: We collect purchase and transaction historical information about your transactions with us, including details about products associated with the Services you receive from us, and other purchasing tendencies.
  • Communications: We collect the content of emails, text messages, and other communications, call logs, and calendar information. If you send us emails, you should be aware that any information you provide us via email may not be secure or encrypted and could be accessible by others. Please exercise caution when you provide us any personal or confidential information to us using email.
  1. Personal Information We May Obtain from Third Parties

We may obtain Personal Information about you from third parties, including publicly available sources. Such sources may include:

  • Marketing Databases. We may obtain Personal Information about you from marketing databases and other data enrichment companies to improve our advertising and marketing efforts.
  • Third Party Retailers. Third party retailers may provide us Personal Information about you when you order our goods through their e-commerce website. We do not have access to or control over the personal or payment information collected by these third-party retailers during transactions, except to the extent your information is shared with us. We recommend reviewing the privacy policies of these third-party retailers.
  • Publicly Available Information. We may use publicly available information about you that we obtain from websites, search engines and other public sources. We use this information to provide our Services.
  • Other Sources. We may obtain Personal Information about you from other third-party sources. These could include government entities, advertising networks, data brokers, operating systems and platforms, mailing list providers, social networks and advertising and marketing partners.

 

  1. Information We Collect Automatically

When you use the Services, we (or our third-party partners) may automatically collect information about your device and usage of the Services. In some jurisdictions, this information may be considered Personal Information under applicable data protection laws.

We may use cookies and similar tracking technologies (collectively “Tracking Technologies” or “Cookies”) to collect some of this information. Our use of Tracking Technologies is discussed in more detail in Section 8 below entitled “Cookies and Other Tracking Technologies”.

Examples of the type of information we automatically collect using Tracking Technologies include:

  • Device and Online Identifiers: We collect device and other online identifiers, such as account login information, MAC address, IP address, cookie IDs, and social media information.
  • Internet and Other Network Activity Information: We collect information about your browsing activity as well as your interactions with our Site, emails, and advertisements. This information includes the date and time you visit pages on our Site, the items you view, how many times you view a page or item, as well as information concerning any emails or other communications that you open, forward or click-through to our Site. If you use multiple devices to access our Site, we may associate your usage from all your devices together.
  • Geolocation: We collect data about the location of your device, which may be imprecise (i.e., inferred from your device’s IP address). Depending on the device you use to access our Services, (e.g. Apple™, iOS, Google™, Android, Windows, etc.) you may be able to control whether location data is collected from the settings on your wireless device.
5. HOW WE USE YOUR PERSONAL INFORMATION

We collect and use Personal Information about you to operate and improve the Site, deliver the Services and carry out the transactions you have requested. These uses may include providing you with more effective customer service; making the Site easier to use by eliminating the need for you to repeatedly enter the same information; performing research and analysis aimed at improving our products, services and technologies; and displaying content and advertising that are customized to your interests and preferences.

We also use Personal Information about you to communicate with you. We may send certain mandatory service communications, such as welcome letters, newsletters, information on technical service issues, and security announcements. We may also contact you to inform you about changes to the Site or changes to any products or services we offer through the Site. Additionally, we may use your personal information for targeted advertising purposes to provide you with offers and promotions that you may be interested in. You may have certain privacy rights with respect to the processing of your Personal Information for targeted advertising purposes. We may also use Personal Information about you to protect or conduct our business and pursue our legitimate business interests, which include to enforce our Terms of Service and other agreements; to improve the security of our systems and the exercise or defense of legal claims; to comply with privacy laws and other regulations, such as to manage consent requirements; and to comply with our other legal obligations.

6. HOW WE SHARE INFORMATION ABOUT YOU

We may disclose aggregated, anonymized information about you and our other users, as well as information that does not identify any individual, without restriction.

We do not sell Personal Information about you in the sense of receiving cash for the information. However, the definition of the term “sale” in some states is broad enough to include transactions that could constitute a “sale” under state law. For example, if you are a resident of Colorado, our use of cookies and tracking technologies constitutes a “sale” of personal information to third-party advertisers. See discussion below in the Section entitled “Your Privacy Rights – Notice to Colorado Residents.”

In certain circumstances, we share certain Personal Information for a business or other lawful purpose. The following describes some of the more common circumstances where we share your Personal Information:

  • Other Companies. We may disclose Personal Information about you to vendors to perform services on our behalf, to service our customers, or perform any contract we enter with you. These vendors include e-commerce platforms, shipping vendors, billing and refund vendors, payment card processors and companies that help us improve our products and services.
  • Legal And Security Purposes. We share your Personal Information with regulators, law enforcement agencies, public authorities and other governmental authorities to comply with law and legal process, to respond to governmental inquiries and lawful requests by public authorities (including to meet national security or law enforcement requirements), and to protect life, property, or the security of CatsOnlyTM or our customers.
  • Enforce Our Rights. We may disclose Personal Information about you to enforce our agreements with you, including for billing and collection purposes.
  • Analytics and Research. We share Personal Information derived from Site usage with analytics and search engine providers that assist us in the improvement of our Site, including Google Analytics. We also use Personal Information for the research and development of our goods and Services. Please refer to our “Cookies and Other Tracking Technologies” section below.
  • Social Media Companies. We may contract with social media companies to display ads on their services, such as Facebook. These companies may use Cookies and similar Tracking Technologies such as pixels to track your activity. The information collected by these social media companies in this manner is subject to their own privacy policies. Please refer to our “Cookies and Other Tracking Technologies” section below for more information on our analytic providers used for advertising and marketing.
  • Sale of CatsOnlyTM. Your Personal Information may be disclosed to and ultimately transferred to a buyer or other successor of CatsOnlyTM if CatsOnlyTM or its business were to be sold, such as by way of a merger, stock purchase, asset sale, or other transaction resulting in the transfer of CatsOnlyTM’‘s business to new owners. Any potential buyer conducting the due diligence associated with a transaction of this type would be required to execute a confidentiality or similar agreement requiring the buyer not to disclose or otherwise use the Personal Information we have collected about you in violation of that agreement.
  • Bankruptcy. If any bankruptcy or reorganization proceeding were to be brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should such a sale or transfer occur, we would make reasonable efforts to require that the transferee use Personal Information provided through our Services in a manner that is consistent with this Privacy Policy.
7. HOW WE PROTECT YOUR PERSONAL INFORMATION

The security of your Personal Information is important to us. We protect your Personal Information through technical and administrative measures designed to mitigate the risk of unlawful or unauthorized access, destruction, loss, alteration, disclosure or use of Personal Information about you. We store Personal Information in data servers that are maintained at one or more commercial data centers owned or operated by companies that are regularly engaged in the business of storing personal data in secure settings pursuant to industry standards governing data security and privacy.

The safety and security of your Personal Information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the Internet is not completely secure. We cannot guarantee the security of any information you transmit to our Site. Any transmission of information, including Personal Information, is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

8. COOKIES AND OTHER TRACKING TECHNOLOGIES

 

  1. How We Use Tracking Technologies

Like many other companies, we use Cookies and other Tracking Technologies to track activity on our Site and store certain information. The Tracking Technologies we may use include the following technologies:

  • Cookies or Browser Cookies. A Cookie is a small file placed on your computer or other device. You can instruct your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if you do not accept Cookies, you may not be able to use some parts of our Service. Unless you have adjusted your browser setting so that it will refuse Cookies, our Services use Cookies.
  • Flash Cookies. Certain features of our Site may use local stored objects (or Flash Cookies) to collect and store information about your preferences or your activity on our Site. Cookies can be "Persistent" or "Session" Cookies. Persistent Cookies remain on your personal computer or other device when you go offline, while Session Cookies are deleted as soon as you close your web browser. We use both Session and Persistent Cookies for the purposes described below:

  • Strictly Necessary Cookies. Strictly Necessary Cookies are a Session Cookie. These Cookies enable basic functions on the Site, like page navigation and access to secure areas of the Site. The Site cannot function properly without these Cookies. As such, Strictly Necessary Cookies will always be collected regardless of your Cookie settings. Examples of how we use Strictly Necessary Cookies follow:
  • Preserving your Site session state across page requests;
  • Distributing traffic to the Site across several servers to optimize response times and improve your website experience;
  • Identifying trusted web traffic to keep the Site secure;
  • Storing your Cookie consent state for the current Site you’re visiting.
  • Functional/Preference Cookies. Functional (also referred to as Preference) Cookies are a Persistent Cookie. They enable the Site to remember information that changes the way the Site behaves or looks during your experience, like your preferred language, the font text appears in, or the region that you are located in. Preference Cookies are used to establish a unique user ID that recognizes you on returning visits to improve and personalize your experience on our Site.   • Performance/Statistics Cookies. Performance (also referred to as Statistics) Cookies are a Persistent Cookie. They help us understand how visitors interact with the Site by collecting and reporting information anonymously. Examples of how we use Statistics Cookies follow:
  • Anonymously logging details about your browser and computer through a website like Google Analytics;
  • Collecting anonymous data on your visits to the Site, such as the number of visits, average time spent on the website and what pages have been loaded, in order to generate reports for optimizing the Site’s content;
  • Determining what type of device (smartphones, tablets, computers, TVs etc.) is being used to access the Site;
  • Gathering anonymous, technical information regarding your browser, operating system, IP address and screen resolution as well as your navigation on the website.

 

  1. Performance Cookies We Use

Google Analytics

We use Google Analytics, a web analytics service provided by Google, Inc. Google Analytics uses cookies to help us analyze how users interact with our Site, compile reports on their activity, and provide other services related to their activity and usage. The technologies used by Google may collect information such as your IP address, time of visit, whether you are a returning visitor, and any referring website. The information generated by Google Analytics is transmitted to and stored by Google and is subject to Google’s privacy policies.   1. Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications on our Site, including advertisements, may be served by advertisers, ad networks and servers, content providers, application providers and other third parties. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across other online services.   1. How You Can Opt Out of Cookies

When you first visit our Site, we will present you with a banner that offers you choices about whether to accept or reject Cookies or Tracking Technologies of different types. 9. HOW TO MANAGE YOUR PRIVACY RIGHTS

Subject to our legal requirements and legitimate business needs, we strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Marketing Materials. If you do not wish to continue receiving certain marketing materials (e.g., email messages), you can opt-out of receiving these materials by following the unsubscribe instructions provided in the materials. Please note that these options do not apply to communications primarily for the purpose of administering orders, contracts, support, product safety warnings, software updates, or other administrative and transactional notices.
  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of our Site may then be inaccessible or not function properly. To manage your Cookie settings, please refer to our Cookie banner on our Site or click on the “Do Not Sell or Share” link at the lower right-hand corner in the footer on our Site.
  • Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by checking the relevant box located on the form on which we collect your data. You can also always opt-out by logging into the Site and adjusting your user preferences in your account profile, checking or unchecking the relevant boxes, or by sending us an email with your request to contact@catsonly.vet
  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out through the Cookie banner on our Site or clicking the “Do Not Sell or Share” link at the lower right-hand corner in the footer on our Site.
  • Account Deletion. Requests to delete your account may be emailed to contact@catsonly.vet with “Delete Account” in the subject line.

We may work with third parties, such as Google Ad Manager, that collect and use information about your website over time and across our Site. These third parties may use cookies, web beacons, pixels, and other similar technology to collect this information, and use it to infer your interests and deliver relevant advertising to your browser or device, and browsers or devices associated with it. This activity is called interest-based advertising. We do not control such third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way, such as https://adssettings.google.com. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website as well as members of the Digital Advertising Alliance here.

When you exercise choices through these tools, you will still receive advertising, but that advertising may be less relevant to you. After you make your choices, data will no longer be collected from your browser or device for interest-based advertising on that browser or device, or associated browsers or devices. Additionally, data from those associated browsers and devices will not be used for interest-based advertising on the browser or device for which you made your choices. Data may still be collected for other purposes, such as analytics, reporting, and research. If you delete your cookies, or use multiple browsers or devices, you will need to register your opt-out choices again.

Some devices and browsers support a “Do Not Track” (or, DNT) feature, a privacy preference that you can set in certain web browsers, which is intended to be a signal to websites and services that you do not wish to be tracked across different websites or online services you visit.

10. OUR RETENTION OF PERSONAL INFORMATION

We keep Personal Information about you for as long as is necessary to provide the Services to you or to meet the business purpose and need for which it was collected as described in this Privacy Policy or explained at the time we collected the information. This includes maintaining and improving the performance of our Services, keeping our Services secure, and maintaining appropriate business and financial records. Most of our retention periods are determined on the basis of this general rule.

If we process Personal Information on the basis of consent (including consent to extended storage), we store the data for as long as necessary in order to process it according to your consent or until you withdraw your consent.

We also retain and use Personal Information to protect as well as enforce our rights and comply with our legal obligations. Legal requirements (such as record retention requirements or litigation holds) may require us to retain some or all of the Personal Information we hold for a longer period of time even after our business purpose or need expires.

11. LINKS TO THIRD PARTY SITES AND SERVICES

Our Site provides links to third-party websites. These third-party websites may include features such as apps, tools, and widgets. We provide access to these links and services as a convenience and to enhance your experience with our Site. However, providing access to these links and services should not be interpreted as CatsOnlyTM endorsing any third party’s products, Site, or services. We do not endorse specific third parties or their goods or services, regardless of whether such third parties offer goods or services on our Site. We also do not make any guaranty about the accuracy, content or quality of the information provided by third-party website, and we assume no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content that may reside on any third-party site or that may be communicated via any third-party service.

Any relationship between you and such third parties will be governed exclusively by the terms offered by the third party and agreed to by you. If you provide third parties with any Personal Information or other information, their use of such information will be subject to their privacy policies, if any, and will not be governed by this Privacy Policy. In addition, if you accept third-party goods or services advertised on our Site, a third party may be able to determine that you have a relationship with us (e.g., if the offer is made only through our Site). We recommend that you review their privacy policies to learn about their privacy practices, including details on the Personal Information they may collect about you.

For avoidance of doubt, if we provide links to social media platforms, such as Facebook or Instagram, and you choose to visit those websites through our links, please note that the information you post, transmit or otherwise make available on those websites may be viewed by the general public. We do not control user-posted content on social media homepages and are not responsible for any third-party use of your information that you have posted, transmitted or otherwise made available there.

12. YOUR PRIVACY RIGHTS - NOTICE TO COLORADO RESIDENTS

This portion of our Privacy Policy applies only to residents of the state of Colorado and applies only to the extent of any inconsistency with the information above. All terms not otherwise defined in this portion shall have the meanings defined under the Colorado Privacy Act (“CPA”).

  • Right to Delete: The right to delete Personal Information provided by or obtained about you.
  • Right to Obtain a Copy: The right to obtain a copy of your Personal Information that you previously provided to us in a portable and to the extent technically feasible, readily useable format that allows you to transmit the data to another controller without hindrance, where the processing is carried out by automated means.
  • Right to Opt-Out: The right to opt out of the processing of your Personal Information for purposes of: (1) targeted advertising, (2) the sale of Personal Information, or (3) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

 

We do not sell your Personal Information in the sense of receiving cash for the information. In order to verify requests and the information in it, you must provide, at a minimum, your name and an email address and respond to a confirmation email that will be sent to that address. We may ask that you provide a photo of an official government issued ID.
